Terms & Conditions

The Terms and Conditions below form the basis of the contractual relationship between All-Ways Han's Travel Services trading as Han's China Tours and its clients. It is extremely important that you, the client, understand and accept these Terms and Conditions as well as all web contents before you book your tour. By make a booking with Han's China Tours, you acknowledge that you have read and agree to the terms and Conditions below.

Reservations and Deposit

At the time of booking confirmation, you must complete a Booking Form, accepting on behalf of all your party the Terms and Conditions, and pay a non-refundable deposit of AU$400 (per person, per tour). Deposit and Booking Form must be received by Han's China Tours within 7 days of confirmation. If for any reason the deposit is not received by Han's China Tours, any reservations already made in respect of the tour will be automatically cancelled.
Any reservations are subject to availability at the time of booking.

Payment

The balance of payment for the tour is due 60 days prior to departure. If booking is made within 60 days, full payment must be made immediately upon confirmation. If for any reason the balance of payment is not received by Han's China Tours by the due date, we reserve the right to treat your booking as cancelled and to apply cancellation charges. Han's China Tours accepts no responsibility or liability whatsoever in respect of any payment made by you to your travel agent. Payment is only made when it is actually received by Han's China Tours.

Cancellation by You

Cancellation of a booking must be made in writing, by the person signing the Booking Form. If for any reason the client cancels a tour, the following cancellation fees will apply:

Up to 60 days prior departure - AUD $100 of deposit
Between 40 - 59 days prior departure - forfeit of total deposit
Between 15 - 39 days prior departure - 50 % of total booking cost
Between 8 - 14 days prior departure - 70 % of total booking cost
Between 0 - 7 days prior departure - 100 % of total booking cost
Cancellation fees for air tickets will apply as determined by Airline Tariff Regulations.
Depending on your reason for cancellation, these charges may be recoverable under your insurance policy.

Refunds

Refunds are not given for unused services, except those that can be recovered from airlines for unused flights.
After the tour has begun, there will be no refund for unused services due to your early departure, late arrival, missed days on tours.

Cancellation by Us

Han's China Tours reserves the right in any circumstance to cancel any tour. However, in no case will Han's China Tours cancel the tour less than 60 days before the scheduled departure date except for reasons of force majeure (see below) or failure on the client's part to pay the total tour cost. On occasions where Han's China Tours is unable to provide the tour booked, we will refund all payments you have made to Han's China Tours, or offer an alternative tour of comparable standard. Han's China Tours will not be liable for any claims made by you or for any additional costs incurred by you.

Force Majeure

Compensation payment does not apply where performance of our contract with you is prevented by riot, civil strife, risk or threat of war, terrorist activity, industrial dispute, natural disaster, fire, extreme weather conditions, closure or congestion of airports or ports, cancellation or change of scheduled airlines or similar events beyond our control.

Tour Prices

Prices are based on tariffs and exchange rates as at March 2004 and are quoted in Australian Dollars. Prices are subject to changes without notice. In the event of changes in currency exchange rates, service providers' tariffs, fuel prices, and other tour components, Han's China Tours reserves the right to adjust prices at any time up to and including the date of departure. Han's China Tours will contact our client and/or travel agent to advice of any changes of price. Han's China Tours will not accept responsibility if your travel agent fails to pass price change information on to our clients.

Travel Documents

It is the responsibility of the client to be in possession of a valid passport, visa permits and vaccination and other medical certificates as may be required for the whole of the tour. Han's China Tours does not accept responsibility for changes in regulations for visas or any particular requirements for visas. Han?s China Tours does not accept responsibility or liability whatsoever for the client?s failure to obtain appropriate documentation.

Travel Insurance

Travel Insurance is mandatory for all clients participating in Han's China Tours. Before the client commences a tour he or she must arrange his or her insurance with a reputable insurer, with protection for the full duration of the tour, to cover personal injury, medical expenses, repatriation expenses, loss of luggage and the expenses associated with cancellation or curtailment of a tour. If a client becomes ill, all hospital expenses, doctor's fees and repatriation costs are the client's responsibilities and Han's China Tours will not be liable for any refund of the tour cost.

Group Departure

Quoted tour prices are based on a minimum number of people travelling together and staying in twin share accommodation as stated on each tour. Should be the minimum number of people not be attained, Han's China Tours reserves the right to cancel, amend or re-cost the tour programs. In such rare cases, we will endeavour to provide our clients with the best possible alternative tour or the client may continue the tour as amended or cancel participation of the tour altogether in which case a full refund of the tour cost will be made.


Single Departure

Single travellers who are willing to share accommodation with another tour member must advise Han's China Tours at the time of reservation. Han's China Tours will endeavour to match the client with a suitable person for the tour duration. If no match can be made a single supplement fee will be payable to Han's China Tours. For clients who choose to have a sole occupancy of a room throughout the tour, the specified single supplement cost will be payable at the time of full payment.

Health Requirements

Clients should familiarise themselves with any health requirement applicable to areas they intend to visit. The client is solely responsible for compliance with vaccination and other health requirements of governments in countries visited or transited. The department of Health or medical practitioners will be able to assist with current health requirements and recommendations.

Changes to Your Confirmed Itinerary

More than 60 days prior departure, any changes made to a confirmed reservation will incur an administration fee of AU$100 per person, per change, together with any additional costs levied by ground operators, airlines, hotels or other service providers. Within 60 days prior departure, any changes made to a confirmed reservation will incur an administration fee of AU$200 per person, per change, together with any additional costs levied by ground operators, airlines, hotels or other service providers.

Baggage Regulations and Allowance

In accordance with the International Airline Regulations, the free baggage allowance for economy class passengers is 20 kg plus limited cabin luggage. Excess baggage charges are the sole responsibility of the client.

Items not Included in Tour Cost

The tour cost quoted exclude items not specifically referred to in the tour description including, but not limited to, travel insurance, airport taxes, airport construction taxes, excess baggage charges, portage, meals (unless specified), travel arrangements to and from hometown and departure city, laundry, dry cleaning, beverages, incidental expenses, telephone charges, gratuities to tour leader/guide, and any items of a personal nature are not included in tour price.

Complaints/Claims

Should any client wish to make a complaint or claim about the service on the tour, this must be done within 30 days after tour completion in writing and sent by fax, mail or e-mail to Han's China Tours. Han's China Tours will not be held for any claim made later than 30 days after the date of tour completion.

Limitation of Liability

Unless otherwise stated, Han's China Tours acts as agent for service providers when making arrangements for your chosen tour. Where Han's China Tours provides service, it will do so with due care and skill. Han's China Tours is not responsible for the acts or omissions of others, including tour guides, tour operators, airlines, accommodation providers or for any loss, damage or expense (including loss of money paid in advance) which you may incur as a result of the acts and omissions (including negligence) of others.

Law of Contract

Any contract arising with the client should be governed by the laws of the Australian Capital Territory.

Special Request

Special dietary requirements must be advised in writing to Han's China Tours when the client makes a booking. Han's China Tours will attempt to provide special meals.
